AI Tools and CUI Do Not Mix Without Controls

Most commercially available AI tools send data to cloud servers for processing. ChatGPT, Microsoft Copilot, Google Gemini, and similar services route your prompts through external infrastructure. If your prompts contain Controlled Unclassified Information, you have created a CMMC violation.

NIST 800-171 Control 3.1.3 requires you to control the flow of CUI in accordance with approved authorizations. Sending CUI to a third-party AI service without a FedRAMP authorized data processing agreement is not an approved authorization.

The Governance Gap

Companies adopt AI tools for productivity gains without evaluating the compliance implications. An engineer uses ChatGPT to debug a control system. A manager uses Copilot to draft a proposal response. Each of these creates a potential CUI spillage event.

What Governed AI Looks Like

Self-hosted inference: Models run on hardware you control, inside your network boundary. No data leaves your facility.

Audit trails: Every AI interaction is logged with who asked what, when, and what the model returned.

Role-based access: Not every employee should have the same AI capabilities. Access is tied to clearance level and need-to-know.

Constitutional rules: Hard limits on what the AI can and cannot do. These rules are enforced at the system level, not by asking the model to behave.

The Competitive Position
